CONSENT TO TELEHEALTH

YOU UNDERSTAND THAT BY CHECKING THE "AGREE" BOX FOR THESE TERMS OF USE AND/OR ANY OTHER SUCH FORM OF THE SAME PRESENTED TO YOU FROM TIME TO TIME ON THE SITE YOU ARE AGREEING TO THESE TERMS OF USE AND THAT SUCH ON-GOING ACTIONS IN USING THE SITE CONSTITUTE A LEGAL SIGNATURE AND ON-GOING AGREEMENT TO THESE TERMS OF USE (IN WHATEVER FORM).

All capitalized terms used in this Consent to Telehealth but not defined herein have the meanings assigned to them in the Terms of Use. For avoidance of any doubt, the terms "LIPSERVICE", "we", "us", or "our" refer to Tuan Nguyen PLC and the terms "you" and "yours" refer to the person using the Service.

Please only use our services after you have read this information and subsequently made an informed decision that we are the right provider for you. If you have any questions, please send us a message through our App or Website or email us at support@LIPSERVICE911.com.

Telemedicine involves the delivery of healthcare services using electronic communications, information technology or other means between a healthcare provider and a member who are not in the same physical location. Telemedicine may be used for diagnosis, treatment, follow-up and/or member education, and may include, but is not limited to:

  • Electronic transmission of medical records, photo images, personal health information or other data between a member and a healthcare provider;

  • Interactions between a member and healthcare provider via audio, video and/or data communications; and

  • Use of output data from medical devices, sound and video files.

 

The electronic systems used in the LIPSERVICE Service will incorporate network and software security protocols to protect the privacy and security of health information and imaging data, and will include measures to safeguard the data to ensure its integrity against intentional or unintentional corruption.

 

BACKGROUND ON OUR PLATFORM: LIPSERVICE is a technology platform that integrates medical services, delivered by our team of doctors at Tuan Nguyen, PLC, a medical group. After an initial evaluation our medical team will recommend and prescribe treatment when medically appropriate.  The consultation allows you to ask any questions and our medical team to evaluate whether you are a good candidate for our telehealth model of care. 

A FOCUSED TELEMEDICINE SOLUTION: Please note that LIPSERVICE and Tuan Nguyen, PLC focus exclusively on a particular issue which is herpes labialis outbreaks.  We provide telemedicine, meaning that we are a digital doctor's office. We are focused specifically on providing the best care around this and related issues. We are not a substitute for a primary care doctor to take care of other health needs, such as your gynecologist, cardiologist, or other specialty care.  You understand that you will not receive any other medical services that go beyond the diagnosis and treatment of herpes labialis (oral herpes/cold sore) outbreaks.

NOT FOR EMERGENCIES: We do not provide care on an emergency basis. Please do not use us in a medical emergency. In an emergency, dial 911 or go to a hospital emergency department.

NO DUTY OF CARE PRIOR TO ACCEPTANCE AS A PATIENT:  Please note that our doctor only takes responsibility for your care after you have created an account, answered all the required health-related questions, made payment, and the doctor has subsequently reviewed your data – and determined that you are a good candidate for our telemedicine services who we are accepting as a patient.  Please understand that our duty of care does not begin at the earlier points of answering your questions, making payment, or reviewing your data.

RIGHT TO DECLINE PATIENT:  Please understand that the doctor has a right to refuse to take responsibility for your care if, in the doctor’s professional judgment, you are not a good candidate for our service. Completing a visit in the App or Website and making payment,  starting a video visit, or sending a message through the app do not, by themselves,  create a duty of care or a doctor-patient relationship.

 

NO PROFESSIONAL MEDICAL ADVICE PRIOR TO ACCEPTANCE:  Please note that the only content in the App or Website that constitutes professional medical advice is the personalized messages the doctor sends you after taking responsibility for your care, along with any content that the doctor links to in such messages and advice that a doctor provides in a video/audio visit. All other information is for information purposes only. No other content in the App or Website constitutes professional medical advice. Information in the health questions about who we can and cannot treat does not constitute professional medical advice. Do not disregard professional medical advice or delay in seeking it because of something you have read on our App or Website.

AGREEMENT TO REVIEW ALL CONTENT: You understand that you must read and understand this Consent to Telehealth, the Terms of Use, the Privacy Policy, the FAQs, and the information provided about specific services before you begin interacting and using the LIPSERVICE platform. You understand that to read important information, you may need to both click on links and various titles to expand the information that's visible below, and that, without clicking on links and titles, you will not be able to read important information that enables you to give informed consent to treatment.

AGREEMENT TO ANSWER TRUTHFULLY AND USE OUR PLATFORM HONESTLY: You understand that by, using LIPSERVICE, you accept the responsibility to provide full and truthful answers to all questions and, when requested, to provide all other data in the most accurate form possible.  The doctor relies exclusively upon information that you provide to decide whether or not treatment is safe and appropriate, and, if you provide incorrect information, then you will be at greater risk of adverse events from any treatment that the doctor prescribes and you receive that isn't necessary, appropriate, or safe.  It is important that you do not create more than one account. Creating more than one account makes it impossible for the doctor to see the full history of care that you've received from LIPSERVICE. This increases the chances that the doctor will not have access to important information and photos in your medical record that could influence the doctor's clinical decision.

CONSENT TO ACCESS MEDICATION HISTORY: You understand that by using LIPSERVICE, you are giving explicit consent for the doctor to access medication history, where it's available, from records provided by pharmacy databases via the services of Surescripts and/or DoseSpot.

 

Possible Benefits of Telemedicine

  • Can be easier and more efficient for you to access medical care and treatment.

  • You can obtain medical care and treatment at times that are convenient for you.

  • You can interact with providers without the necessity of an in-office appointment.

 

Possible Risks of Telemedicine

  • Information transmitted to your provider(s) may not be sufficient to allow for appropriate medical decision making by the provider(s).

  • The inability of your provider(s) to conduct certain tests or assess vital signs in-person may in some cases prevent the provider(s) from providing a diagnosis or treatment or from identifying the need for emergency medical care or treatment for you. The inability to have direct, physical contact with you is a primary difference between telehealth and direct in-person service delivery.

  • Your provider may not able to provide medical treatment for your particular condition via telemedicine and you may be required to seek alternative care.

  • Delays in medical evaluation/treatment could occur due to failures of the technology.  There may be a delay until the next business day before a doctor reviews any request for treatment and reads any messages sent. You must check the App or Website for messages because this is the way that the doctor will communicate important information. Failure to check the App or Website regularly may delay care.

  • Security protocols or safeguards could fail causing a breach of privacy.

  • Given regulatory requirements in certain jurisdictions, your provider(s) treatment options, especially pertaining to certain prescriptions may be limited.

 

By accepting this Consent to Telehealth, you acknowledge your understanding and agreement to the following:

  • I have read this special Consent to Telehealth carefully, and understand the risks and benefits of the use of telemedicine in the medical care and treatment provided to me through LIPSERVICE’s platform by "Providers".

  • I give my informed consent to the use of telemedicine by providers affiliated with LIPSERVICE.

  • I understand that the delivery of healthcare services via telemedicine is an evolving field and that the use of telemedicine in my medical care and treatment may include uses of technology not specifically described in this consent.

  • I understand that while the use of telemedicine may provide potential benefits to me, as with any medical care service no such benefits or specific results can be guaranteed. My condition may not be cured or improved, and in some cases, may get worse.

  • I understand that "Providers" may determine in his or her sole discretion that my condition is not suitable for treatment using telemedicine, and that I may need to seek medical care and treatment in-person or from an alternative source.

  • I understand that the same confidentiality and privacy protections that apply to my other health care services also apply to these telemedicine services.

  • I understand that I have access to all of my health and wellness information pertaining to the telemedicine services in accordance with applicable laws and regulations.

  • I understand that I can withhold or withdraw this consent at any time by emailing LIPSERVICE with such instruction. Otherwise, this consent will be considered renewed upon each new telemedicine consultation with "Providers".

  • I agree and authorize my health care provider to share information regarding the telemedicine exam with other individuals for treatment, payment and health care operations purposes.

  • I agree and authorize my health care provider to release information regarding the telemedicine exam to LIPSERVICE and its affiliates.
